Terms of Service

Effective date: April 17, 2026

These Terms of Service (“Terms”) govern your use of the DocsBrew platform (“Service”). By creating an account or using the Service you agree to these Terms. If you’re accepting on behalf of an organization, you represent that you have authority to bind that organization.

1. The Service

DocsBrew provides an AI-powered sales agent that customers embed on websites and connect to messaging channels (WhatsApp, Telegram, Instagram, Facebook) to engage visitors, answer questions, and capture leads. Features and limits depend on your plan.

2. Account and eligibility

  • You must be at least 18 years old and able to enter contracts under your local law.
  • You are responsible for keeping your credentials secret and for activity under your account.
  • One person or organization per account. Don’t share logins.

3. Acceptable use

You agree not to use the Service to:

  • Violate law, infringe intellectual property, or harass others.
  • Send spam, run phishing campaigns, or impersonate another person or business.
  • Upload malware, attempt to reverse engineer the Service, or circumvent rate limits.
  • Deploy the chatbot in contexts that require regulated professional advice (medical, legal, financial) without qualified human review.
  • Violate the policies of connected channels (WhatsApp Business Policy, Meta Platform Terms, etc.).

We may suspend or terminate accounts that breach this section. Severe breaches (fraud, illegal content) take effect immediately and without notice.

4. Your content

You retain ownership of the content you upload (websites, catalogs, documents, conversations captured by your chatbot). You grant DocsBrew a worldwide, non-exclusive license to process that content solely to operate the Service for you. We do not use your content to train third-party AI models.

You represent that you have the right to upload and process your content, including any personal data, and that you have obtained the consents required by applicable law (for example, informing website visitors that their conversation is processed by AI).

5. Fees and billing

  • Plans are billed monthly in advance. Prices are shown on the pricing page or in your dashboard.
  • Kenyan customers can pay by M-Pesa STK Push. Other customers pay by card (once enabled).
  • All fees are non-refundable except where required by law or explicitly stated.
  • If a payment fails, we may suspend your account after notice. Suspended accounts retain data for 30 days, after which it may be deleted.
  • Taxes (VAT, withholding) are your responsibility unless stated otherwise.

6. Uptime and support

We aim for high availability but do not guarantee an SLA on free or starter plans. Paid plans may include written SLAs in a separate order form. Support is provided by email at support@docsbrew.com.

7. Third-party services

The Service integrates third parties (LLM providers, WhatsApp Business Platform, M-Pesa, etc.). Their availability, pricing, and terms are outside our control. Channel providers may charge their own fees (for example, WhatsApp conversation fees) — those are not included in DocsBrew’s fees.

8. Intellectual property

DocsBrew, the widget, dashboard, documentation, and all related code are owned by us and protected by copyright. We grant you a limited, non-exclusive, non-transferable license to use the Service during the term of your subscription.

9. Termination

You can cancel at any time from the billing page. Cancellation stops future renewals. We can terminate the Service with 30 days’ notice, or immediately for breach. On termination your data is retained for 30 days for recovery, then deleted.

10. Warranty disclaimer

The Service is provided “as is.” To the extent permitted by law, DocsBrew disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. AI-generated responses may be incorrect — you are responsible for how you use them.

11. Limitation of liability

To the maximum extent permitted by law, DocsBrew’s total liability to you for any claim arising out of these Terms or the Service is limited to the fees you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, even if advised of the possibility.

12. Indemnity

You agree to indemnify and hold DocsBrew harmless from claims arising out of (a) your content, (b) your use of the Service in violation of these Terms, or (c) your violation of applicable law.

13. Governing law

These Terms are governed by the laws of Kenya, without regard to conflict of laws principles. Disputes will be resolved in the courts of Nairobi, Kenya, unless the parties agree to arbitration.

14. Changes

We may update these Terms. Material changes will be announced by email or in-app at least 14 days before taking effect. Continued use after the effective date means you accept the changes.
